These Terms of Use (“Terms”) govern access to and use of the website flushactive.world and related services offered by Flushactive.world (“we”, “us”). By using the site, you agree to these Terms. If you do not agree, do not use the site.

If you are a consumer within the meaning of the Dutch Civil Code (Burgerlijk Wetboek, Book 6), mandatory consumer protection rules prevail over these Terms where they offer you greater protection.

2. Services and nature of information

We provide:

  • Free general online information about varying everyday meals and related lifestyle topics for adults in the Netherlands;
  • Optional paid consultations and workshops (in person in Amsterdam or online) about meal variety, shopping, and cooking habits—priced and confirmed before booking.

We do not sell food products, supplements, or medical devices. We do not advertise guaranteed weight loss, cure of disease, or improvement of specific health conditions.

Content is for general information only. It is not medical, dietetic, psychological, or therapeutic advice. We do not diagnose conditions or prescribe diets. You remain responsible for your food choices. Consult a doctor, registered dietitian (Voedingsdeskundige), or other qualified professional for individual health needs.

Advertising on third-party platforms (e.g. Google Ads) may point to this site; the same transparency rules apply: you always see who we are, how to contact us, and that services are educational.

3. Availability and changes

We aim to keep the site available but do not guarantee uninterrupted access. We may modify, suspend, or remove content or features without prior notice. We may update these Terms; the “Last updated” date will change. Continued use after changes constitutes acceptance where permitted by law.

4. Account and age

The site does not require user registration. You must be at least 16 years old to submit personal data via our contact form (see Privacy Policy). Consultations are intended for adults unless agreed otherwise in writing with a parent or guardian.

5. Acceptable use

You agree not to:

  • Use the site unlawfully or in a way that harms others or our systems;
  • Attempt unauthorised access, introduce malware, or overload our infrastructure;
  • Scrape or systematically copy content for competing commercial databases without written consent;
  • Submit false, defamatory, or unlawful material via our contact form;
  • Misrepresent your identity or affiliation.

We may block access or report serious abuse to authorities.

6. Bookings, fees, and cancellations

Consultations and workshops may be subject to separate confirmation (time, price, format, cancellation window). Unless otherwise agreed in writing:

  • Prices and payment method are confirmed before the service starts;
  • Cancellation terms are communicated at booking;
  • We may reschedule events with reasonable notice.

For distance contracts with consumers (e.g. online bookings), additional mandatory information and withdrawal rights apply under Dutch and EU consumer law; we provide that information in the booking confirmation where relevant.

7. Right of withdrawal (consumers in the EU/Netherlands)

If you are a consumer and book a paid consultation or workshop at a distance (online/phone/email), you generally have a 14-day right of withdrawal under Dutch law (implementation of the EU Consumer Rights Directive), unless a statutory exception applies (e.g. service fully performed within 14 days with your prior express consent and acknowledgement that withdrawal is lost).

To withdraw, send a clear statement to touch@flushactive.world within 14 days of booking. We will refund payments within 14 days using the same payment method, subject to services already provided at your request.

8. Intellectual property

Text, design, logos, images, and other materials on this site are protected by copyright and related rights. Rights belong to us or our licensors.

You may view and print pages for personal, non-commercial use. You may share short quotations with a clear, active link to the source page. Any other reproduction, distribution, or commercial use requires our prior written permission.

9. Liability

We take care in preparing content but do not warrant that all information is complete, current, or error-free. Use of recipes and tips is at your own risk (e.g. allergens, food safety in your kitchen).

To the fullest extent permitted under Netherlands law (including Title 6 of the Dutch Civil Code):

  • Our liability for death or personal injury caused by our intent or gross negligence is not limited;
  • For other damage, we are only liable for intent or gross negligence, or for breach of essential contractual obligations (kardinale schulden) in a manner typical and foreseeable, unless mandatory law provides otherwise;
  • We are not liable for indirect loss, consequential loss, lost profit, or data loss arising from use of the site, except where such exclusion is not permitted.

Nothing in these Terms limits mandatory consumer rights under EU/Netherlands law.

10. Third-party services and links

Embedded services (e.g. Google Maps) are operated by third parties under their own terms. External links, if present, are not under our control; we are not responsible for their content.

11. Privacy and cookies

Processing of personal data is governed by our Privacy Policy (GDPR / UAVG) and Cookie Policy (Telecommunicatiewet / consent rules).

12. Complaints

If you have a complaint about our services or the site, contact us at the details in Section 1. We will respond within a reasonable period, typically within 14 days, and seek a fair solution. If you are a consumer, you may also use the EU online dispute resolution platform: ec.europa.eu/consumers/odr. We are not obliged to participate in alternative dispute resolution bodies unless required by law.

13. Governing law and disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules, subject to mandatory provisions of the law of your country of residence if you are a consumer in the EU/EEA.

Disputes shall be submitted to the competent court in Amsterdam, Netherlands, unless mandatory consumer law grants you the right to bring proceedings in your country of residence.
